Tort Reform

My wife asked me about this subject the other day and I thought I would write something quick about it.  Her question was from a co-worker who stated that we have a constitutional right to sue for damages.  Now this in context is correct, but it does not address the primary issue of tort reform.  I do not see anywhere in the constitution a right to penalize others financially for their wrongs against us.  While a court may decide to levy a penalty against a corporation or individual for negligence, it is not a constitutional right to benefit financially from the court’s ruling. American Principals

Why are politicians out of favor in America?  It is because they do not stand for principals, or the principals that they represent are contrary to those on which this country was founded.  This country was founded on true principals.  It was founded on the experience of societies throughout the ages.  These principals centered on three basic rights from which all others emanate.  These include the rights of Life, Liberty, and Property.  Society can only pursue happiness when these rights are fully protected.  The basic concept of these principals is that the individual is the most important unit in society, followed by the family, then your neighborhood, and so on to the nation.  These principals are outlined in the Constitution and Bill of Rights.  These documents create specific borders for the federal government to ensure that it cannot encroach on individual’s rights.  There is a reason that much of the language of these documents is negative.  They are a protection for all, and therefore specify what cannot be done by the government.  This is on purpose.   It is to put forth the idea that government is to be controlled, and therefore does not have rights or responsibilities to provide, except within carefully defined parameters. Third Party Rising?

I came across this today while searching other conservative blogs, and must say I am very impressed!  I am not decided on the best course of action for reform our nation, whether it be through the Republican party or a new party.  The benefit of the using the Republicans is that they, as Glenn Beck has stated, already have the framework in place.  However, this existing framework has a stigma attached to it that many find distasteful.  It would be best that the reformist movement be open to left and right wing individuals that love the constitution and our country.  All this said I would like to share this new ”American Federalist Party” platform being developed online.  It is very interesting and in many ways a perfect example of the concerns of We the People. Leno, Damon, Tennis Balls, and the Declaration of Independence

I found it of unique interest that Matt Damon, while reciting the Declaration of Independence, and juggling tennis balls on Leno’s show, stated that the “best part” is as follows:

That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

It is somewhat concerning that a progressive would find such a statement to be so interesting, being that the current administration is doing just that.  They are fundamentally changing this country to be more reflective of their desires in government.  The problem is the government they are constructing is very oppressive of freedom and denies many personal liberties in the name of making a certain few comforts more available.

In Twently Years

What is the end game?  When it comes to partisan politics, I argue that there is none.  In today’s partisan government there is not much thought given to the consequence of ones actions in years to come.  There is only the thought of how votes will effect the party and a politician’s chances at re-election.  This is the root of our countries current peril.  Those who have been putting in place the policies that have turned government on its head have a plan.  They do not plan for re-election.  They plan for the end result!  It does not matter if they lose an election or suffer a defeat.  The end is always in mind.  The means are not important.  They are working toward their twisted ideal.  Nothing will stop their progress, but the well-thought, planned, opposition.  We must Discover our end result.  So that brings us to the question we have been asked so often in our lives:  Where do you want to be in X years?  Politicians take this question personally.  They think of their careers and what they can do to enact a change that will cause a re-election in 4 years.  As a society we need to ask this same question so I will ask… WHERE IS AMERICA IN TWENTY YEARS? March on Washington – Tea Party Time

September 12th, 2001

I remember this day for one distinct reason.  After the previous traumatising day, looking at the brutal attack waged against my fellow Americans, I left my home and began my morning bike rideto school.  I was concerned for what lay ahead.  Was anywhere safe?  How many attacks would happen today, I thought?  As I rode down the streets, I noticed something that made me feel a little more comfortable.  Before me, in front of each home stood the flag.  Old glory hung, half staff, on every pole, but in front of each house it was displayed with pride and solidarity.  It was an odd feeling seeing that every American felt the same way.  Patriotism was displayed in every window.  There was no bickering between partisans.  This fact had been displayed boldly by the singing of God Bless America the day before in congress.  America was changed.  We were fearful, but determined.  There was only one collective thought, we will triumph!
